A Brownstown man is being held in the Fayette County Jail and is facing multiple charges following an incident this past Thursday evening that involved a shot fired in a residence and the defendant allegedly fleeing the scene.
38 year old Cody A. Summers is facing 3 felony charges in Fayette County Court. Summers is charged with Aggravated Battery, which is a Class 3 Felony, for allegedly striking an individual in the shoulder with his cellphone. Summers also faces a charge of Reckless Discharge of a Firearm, which is a Class 4 Felony, for allegedly discharging a firearm inside the residence. And, Summers also faces a charge of Unlawful Possession of a Weapon by a Felon, which is a Class 3 Felony.
Fayette County Sheriff’s Office reports say that on Thursday evening at 7:38 pm they received a 911 call in reference to a male subject being hostile and not wanting to leave the residence in rural Brownstown. Reports say that once the first Deputy arrived on scene it was made known that the situation had become a domestic battery, a firearm had been involved, a shot was fired inside of the residence and the male subject fled the residence on foot. No one inside the residence was struck by the gunshot. The Fayette County Sheriff’s Office reports says that at 10:22 pm, 38 year old Cody A Summers was located next to a field in a tree line northwest of the residence. The report says that Summers came out of the tree line and was taken into custody without further incident. The report says that firearm was later located in the tree line a short distance away.
On Monday, the court granted the state’s petition to deny pre-trial release for Summers. He will next appear in Fayette County Court for a Preliminary Hearing on November 27th.
